Q:  What is mediation and is it helpful?

A:  Mediation is an informal and confidential process for helping parties resolve disputes instead of going to court. With the help of a Rule 31 Listed Civil Mediator, parties work together to communicate and find mutually agreeable solutions to their problems. A Mediator does not decide who is right or wrong, and does not impose a settlement. A Mediator’s role is to facilitate a dialogue that will help the parties develop solutions to their particular situation.  Mediations are held privately, and all discussions are confidential to the extent allowed by the law.  The Mediator is a neutral third party and is often an attorney or former judge.

Mediation often successfully resolves a dispute which may include a divorce, a personal injury lawsuit, a workers’ compensation claim or even a business dispute.  It is usually wise to choose a mediator that shares the jurisdiction and area of practice related to your dispute.
